TERMS OF USE
Terms of Service
Please review these Terms carefully before accessing the Awekelas website or purchasing Return Pallets and mixed return merchandise.
Last Updated: July 17, 2026Overview
This website is operated by Awekelas. Throughout the website, the terms “Awekelas,” “we,” “us,” and “our” refer to Awekelas.
Awekelas provides this website, including available information, tools, features, products, and services, subject to your acceptance of these Terms of Service and all additional policies referenced on the website.
By visiting the website, creating an account, submitting information, or purchasing a product, you engage in our “Service” and agree to these Terms of Service.
These Terms apply to website visitors, customers, purchasers, merchants, content contributors, and other users of the Service.
If you do not agree with these Terms, you should not access the Service or complete a purchase.
The Awekelas store is operated using third-party e-commerce, payment, hosting, analytics, tracking, and fulfillment services that help us provide the website and process orders.
Section 1 — Eligibility and Online Store Terms
By using this website, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
You may not use the website, products, or Service for an illegal, fraudulent, abusive, or unauthorized purpose.
You must not introduce viruses, malicious code, automated attacks, data scraping tools, or other technology intended to interfere with the website, other customers, or our systems.
A material violation of these Terms may result in suspension or termination of access to the Service.
Section 2 — General Conditions
We reserve the right to refuse, restrict, or cancel service or orders for lawful reasons, including suspected fraud, payment risk, inventory unavailability, policy violations, inaccurate information, pricing errors, or misuse of the website.
You agree not to reproduce, duplicate, copy, resell, exploit, reverse engineer, or commercially use any part of the website or Service without prior written authorization from Awekelas.
Payment information is handled through authorized payment providers. Other information may be transmitted across different networks and systems as necessary to provide the Service.
Section 3 — Return Merchandise Condition
Awekelas sells Return Pallets and mixed return-merchandise lots that may include:
- Customer returns;
- Open-box products;
- Shelf pulls;
- Overstock and excess inventory;
- Previously handled or used merchandise;
- Uninspected merchandise;
- Incomplete, defective, damaged, or salvage-condition goods.
Merchandise may show damaged or missing packaging, scratches, dents, stains, cosmetic wear, missing accessories, incomplete components, functional defects, or other visible or hidden issues.
Unless expressly stated otherwise on the applicable product page, merchandise is sold “as is” and may not have been individually tested or inspected.
Awekelas does not guarantee that every product will be new, complete, functional, resale-ready, or suitable for a particular purpose.
Section 4 — Return Pallet Tiers and Delivery Format
Awekelas offers different Return Pallet categories and purchasing tiers based on price, merchandise category, inventory allocation, and shipment size.
Unless the product page expressly states that a “Full Commercial Freight Pallet” is included, a Return Pallet tier may represent an allocated portion of mixed return merchandise rather than a complete wooden pallet.
Depending on the selected tier and available inventory, an order may be delivered in one or multiple parcels by a standard shipping carrier.
Purchasing a higher-priced tier does not guarantee a particular brand, product, item count, condition, retail value, resale value, or profit.
Section 5 — Product Images, Descriptions and Estimated Value
Product photographs, videos, advertisements, sample manifests, brand references, product lists, and customer shipment examples may show possible, representative, or previously available inventory.
These materials do not represent the exact contents of an order unless the applicable product page expressly identifies those contents as guaranteed.
Awekelas does not guarantee:
- A specific product, model, or brand;
- A fixed number of items;
- A particular condition or packaging type;
- A minimum retail or resale value;
- A particular resale profit or margin;
- The inclusion of high-value merchandise shown in advertising.
Retail, wholesale, MSRP, or estimated values are provided only as general references. Actual market and resale values may differ.
Section 6 — Accuracy of Website Information
We make reasonable efforts to present useful and accurate information. However, website content may occasionally contain errors, omissions, or outdated information.
Information provided on the website is for general informational purposes and should not be the sole basis for a significant business, financial, resale, or purchasing decision.
We may update or correct website content when necessary but do not undertake an obligation to update every piece of historical or informational content.
Section 7 — Prices and Service Changes
Product prices, promotions, shipping rates, product availability, and purchasing tiers may change without prior notice.
We may modify, suspend, restrict, or discontinue a product, feature, or part of the Service at any time, subject to our obligations concerning orders already accepted and paid.
Price changes do not apply retroactively to completed orders unless a correction is required because of an obvious pricing or technical error and applicable law permits the correction.
Section 8 — Order Acceptance and Availability
Receiving an order confirmation does not always mean an order has been finally accepted or shipped.
We may review an order for payment authorization, inventory availability, address accuracy, purchasing limits, fraud prevention, and compliance with these Terms.
We may limit quantities, refuse an order, or cancel an order before fulfillment for lawful reasons. If we cancel a paid order that has not shipped, the applicable amount will be refunded to the original payment method.
Return merchandise is allocated from changing inventory. An item or category may become unavailable after an order is placed.
Section 9 — Order Changes and Cancellations
Requests to change or cancel an order should be submitted within 48 hours of placing the order and before processing begins.
Once inventory has been allocated, inspected, packed, transferred to a warehouse, or handed to a carrier, an order normally cannot be changed or canceled.
Submitting a request does not guarantee approval. Approved cancellations may be subject to actual payment-processing, handling, storage, or carrier-interception expenses where permitted by law.
Section 10 — Shipping and Delivery
Processing and delivery timeframes displayed on the website are estimates unless expressly guaranteed at checkout.
Delivery may be affected by inventory preparation, carrier processing, weather, public holidays, customs inspections, remote locations, incorrect addresses, and events outside Awekelas’s reasonable control.
Customers are responsible for providing complete and accurate shipping information. Additional expenses caused by an incorrect address, refused delivery, missed appointment, storage, redelivery, or unauthorized rejection may be charged where permitted by law.
If we cannot ship within a timeframe promised at checkout, we may provide an updated shipping estimate and, where required by law, allow the customer to accept the delay or cancel the unshipped order for a refund.
Additional details are provided in the Awekelas Shipping Policy.
Section 11 — Final Sale, Returns and Eligible Claims
Because Return Pallet inventory is mixed, random, and variable, Return Pallet purchases are generally considered final sale.
Refunds or returns will not normally be approved solely because of personal preference, dissatisfaction with the assortment, packaging condition, resale value, inability to resell, or failure to receive a product or brand that was not guaranteed.
Eligible claims may include an incorrect shipment, confirmed non-delivery, material transportation damage, or merchandise materially different from an expressly guaranteed listing.
Eligible claims must generally be submitted within 7 calendar days of confirmed delivery with reasonable supporting evidence.
Unauthorized refused or undeliverable shipments may be subject to original shipping, return shipping, freight, storage, redelivery, handling expenses, and a restocking fee of up to 25%, where permitted by law.
These terms do not limit consumer rights that cannot legally be waived. Please review our Return and Refund Policy.
Section 12 — Billing and Account Information
You agree to provide current, complete, and accurate order, billing, payment, contact, and shipping information.
You agree to promptly update account information when necessary so that we can process transactions and contact you regarding your order.
We may refuse or cancel transactions associated with unauthorized payment methods, suspected fraud, inaccurate information, unusual order activity, or violations of these Terms.
Customers are encouraged to contact Awekelas Customer Support before filing a payment dispute so that we have a reasonable opportunity to investigate. This does not waive any non-waivable payment or consumer-protection rights.
Section 13 — Third-Party Services and Tracking Tools
The website may provide access to third-party payment services, shipping carriers, tracking platforms, analytics tools, applications, or other services.
Third-party services may be governed by their own terms and privacy policies. Awekelas does not control every third-party platform or guarantee its continuous availability, accuracy, or performance.
Tracking events are generally supplied by the applicable carrier. Tracking information may be delayed, incomplete, or changed by the carrier.
Section 14 — Third-Party Links
The Service may contain links to websites or services operated by third parties.
Awekelas is not responsible for the content, security, privacy practices, products, services, or accuracy of third-party websites.
Customers should review the applicable third party’s terms and policies before completing a transaction or providing personal information.
Section 15 — Reviews, Feedback and Submissions
If you submit feedback, reviews, photographs, suggestions, or other content, you confirm that you have the right to submit that material.
You must not submit unlawful, misleading, defamatory, infringing, abusive, threatening, malicious, or deceptive content.
Where legally permitted, you grant Awekelas a non-exclusive, royalty-free license to use submitted content for customer service, website operation, business records, and marketing purposes.
We will not materially alter customer reviews in a manner that misrepresents the customer’s experience.
Section 16 — Personal Information and Privacy
Our collection, use, storage, and disclosure of personal information are governed by the Awekelas Privacy Policy.
By using the Service, you acknowledge that information may be processed by authorized e-commerce, payment, analytics, customer-support, fulfillment, and shipping providers as necessary to operate the Service.
Section 17 — Errors, Inaccuracies and Omissions
Website content may occasionally contain typographical errors, inaccurate product information, pricing mistakes, shipping errors, or omissions.
We may correct errors, update information, or cancel an affected unshipped order when necessary, subject to applicable law.
If a paid order is canceled because of a material error, the applicable amount will be refunded to the original payment method.
Section 18 — Prohibited Uses
You may not use the website or Service to:
- Violate applicable laws or regulations;
- Commit fraud or provide knowingly false information;
- Infringe intellectual-property or privacy rights;
- Transmit malicious code or interfere with website security;
- Harass, threaten, abuse, or impersonate another person;
- Collect customer data without authorization;
- Submit false reviews, claims, or payment disputes;
- Circumvent purchasing limits or security controls;
- Use retailer trademarks to falsely imply official affiliation.
Section 19 — Intellectual Property and Brand Restrictions
Website text, graphics, page layouts, branding, photographs, and other original content owned by Awekelas may not be copied or commercially exploited without authorization.
Amazon and other third-party retailer or product names, logos, and trademarks belong to their respective owners.
References to third-party brands are used only for identification, descriptive, or inventory-source purposes and do not imply sponsorship or endorsement.
Section 20 — Disclaimer and Limitation of Liability
To the maximum extent permitted by law, the website, Service, and return merchandise are provided on an “as is” and “as available” basis, except where a written guarantee expressly applies.
Awekelas does not guarantee uninterrupted website access, continuous product availability, specific resale results, business profits, or that every item in a Return Pallet will be functional or complete.
To the maximum extent permitted by law, Awekelas will not be liable for indirect, incidental, special, punitive, or consequential losses, including lost profits, lost resale opportunities, loss of anticipated value, or lost business.
Where liability cannot be excluded, Awekelas’s maximum liability relating to a purchase will not exceed the amount paid for the affected order.
Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.
Section 21 — Indemnification
To the extent permitted by law, you agree to indemnify and hold Awekelas harmless from third-party claims reasonably arising from your unlawful use of the Service, violation of these Terms, infringement of another party’s rights, or unlawful resale or handling of merchandise.
This section does not require a customer to indemnify Awekelas for Awekelas’s own fraud, willful misconduct, or liability that cannot legally be transferred.
Section 22 — Severability and Waiver
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will remain effective.
Failure by Awekelas to enforce a provision on one occasion does not constitute a permanent waiver of that provision.
Section 23 — Termination
These Terms remain effective until terminated by you or Awekelas.
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe that you have materially violated these Terms, engaged in fraud, misused the website, or created a security risk.
Provisions concerning payment obligations, intellectual property, liability, disputes, and other terms that by their nature should survive will continue after termination.
Section 24 — Entire Agreement and Policy Priority
These Terms, together with the applicable product page, Terms of Purchase Agreement, Shipping Policy, Return and Refund Policy, Privacy Policy, and written order confirmation, constitute the agreement relating to use of the Service and applicable purchases.
If general advertising conflicts with specific disclosures presented on the final product page or at checkout, the specific product-page and checkout disclosures will control, subject to applicable law.
Section 25 — Governing Law
These Terms will be governed by and interpreted under the laws of the State of Texas, without regard to conflict-of-law principles, except where mandatory consumer-protection laws in the customer’s jurisdiction apply.
Any dispute will be handled by a court with appropriate jurisdiction unless the parties agree to another lawful dispute-resolution method.
Section 26 — Changes to These Terms
We may revise these Terms to reflect changes in our Service, products, business practices, technology, or legal obligations.
The current version will be posted on this page with an updated revision date. Continued use of the Service after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.
Material changes will not retroactively remove rights that have already accrued under applicable law.
